1. Why this privacy statement?

Each person (hereinafter "User") who visits or uses the Website or enters into a purchase-sale agreement discloses a certain amount of personal data. This personal data enables Van De Moer Instruments to identify you as a natural person, regardless of whether we actually do so. You are identifiable from the moment it is possible to establish a direct or indirect link between one or more data and you, as a natural person.

We use and process your personal data in accordance with the Privacy Act and other applicable regulations. Any reference in this Privacy Statement to the "Privacy Law" may be understood as a reference to the Belgian law of December 8, 1992 on the protection of privacy with respect to the processing of personal data. By using our Website or entering into a purchase-sale agreement with Van De Moer Instruments, the User declares that they have read this Privacy Statement and agree to the possible collection and processing of personal data as described in this document. Van De Moer Instruments reserves the right to modify its Privacy Statement at any time.

2.1 Controller

Van De Moer Instruments is responsible for data processing and decides unilaterally or in coordination with others what personal data is collected as well as the purposes and technical and organizational means related to the processing of such personal data.

2.2 Processor(s).

Van De Moer Instruments is free to use third parties to process personal data.
A processor is a natural or legal person who processes your personal data at the request and on behalf of the controller. The processor is obliged to ensure the security and confidentiality of the data. The processor works only according to the instructions of the controller.

Van De Moer Instruments uses the following processors:

- Mailchimp: for sending our newsletters. Mailchimp guarantees to respect the legal provisions of the EU-US Privacy Shield;

- Google Analytics: for web analytics. Google guarantees to respect the legal provisions of the EU-US Privacy Shield.

- Combell: for hosting;

- Baldwin: for maintaining the Website. 

3. On what legal grounds does the processing of my personal data rely?

In accordance with the Regulation, we process your data on the following grounds:

- Based on the performance of an agreement with the User or pre-contractual steps taken at the User's request; or

- On the basis of legislative national or international provisions for the purpose of maintaining contractual relations; or

- On the basis of the User's consent to send advertising (direct marketing).

4. What personal data is processed?

Van De Moer Instruments undertakes to collect only the data necessary to fulfill the purposes intended by Van De Moer Instruments. The data we collect is listed below. The list below is by no means exhaustive.

- Contact information;

- Email address;

- Phone number;

- Address information;

This information is collected at the time of your registration on our Website and when you use our services. Other personal data may also be collected later. This data is necessary to provide Van De Moer Instruments' services.

8. What are your rights?

8.1 Guarantee of legitimate and secure processing of your personal data

Your personal data will always be processed for the purposes explained in Article 5.
They are collected and processed in an appropriate, relevant and non-excessive manner and they are not kept longer than necessary to fulfill the purposes set.

8.2 Right of access.

Consequently, you also have the right to know for what purpose your data are processed, what criteria exist to justify our retention of your data, what categories of data are involved, to which recipients your data are sent and what rights you can exercise over your data.

8.3 Right to correct your data

Incorrect or incomplete personal data can be corrected. It is primarily the responsibility of the user to make the necessary adjustments, but it is also possible to request this from us in writing.

8.4 Right to be erased (the right to be forgotten).

You have the right to have your personal data deleted from our database under the following conditions:

- You withdraw your consent to the processing of your data and there is no other legal ground for refusal;

- You have validly exercised your right of opposition;

- Your data were processed or acquired in an illegal manner;

- Your data must be deleted to comply with a legal obligation.

The deletion of data primarily relates to the visibility of the data; it is therefore possible that your deleted data may still be stored temporarily.

8.5 Right to limited processing.

In certain cases, you have the right to request limited processing of your data, especially in the event of a conflict regarding the accuracy of the data, if the data is needed in the context of legal proceedings or during the time Van De Moer Instruments needs to verify that you have properly requested your deletion.

9. How do you exercise your rights?

10. Possibility to file a complaint

If you are not satisfied with the processing of your personal data by Van De Moer Instruments, you have the right to lodge a complaint with the competent Data Protection Authority.
